Employment practices liability (EPL) reviews defined allegations by employees, applicants, or sometimes others affected by workplace decisions. Campgrounds often hire quickly for a short season and supervise staff across lodging, maintenance, food, recreation, and events. The exposure is not the same as a job-related injury: workers compensation addresses a state-regulated employee-injury system, while EPL addresses allegations such as discrimination, harassment, retaliation, or wrongful termination.
Build a people-and-process record
List full-time, part-time, seasonal, temporary, and family workers; locations; managers; turnover; and use of staffing agencies or contractors. Keep job descriptions, applications, wage and hour records, handbook acknowledgements, training, accommodation discussions, complaints, investigations, and discipline consistently and securely. EEOC guidance describes legal obligations but cannot predict a claim or policy response.
Separate the allegation from the insurance section
Ask whether the form addresses discrimination, harassment, retaliation, wrongful termination, hiring, failure to promote, third-party claims, wage allegations, defense costs, and arbitration. Review claims-made reporting, prior knowledge, consent to settle, insured-versus-insured wording, the retention (the amount the business keeps before insurance responds), sublimits, and whether the form covers the entity and individual managers. A policy exclusion or an employment-law remedy may leave a gap even when a complaint is real.
Use qualified employment counsel for legal compliance. Bring the workforce schedule, handbook, claim history, and current declarations to a coverage review and quote request through The Southern Agency’s existing quote portal. The application, form, endorsements, exclusions, reporting duties, jurisdiction, and facts determine coverage.
